Why Do I Need a Personal Injury Lawyer?

Why do you need a personal injury lawyer? Perhaps you are one of the estimated 6,781 workers in Westchester County that have been injured on the job at some point and are unable to continue working. These types of accidents happen all across New York State, you can read more about the statistics here.

Or maybe you have been in a car accident that was not your fault and left you with piles of medical bills.  In White Plains alone, there were six vehicles involved in fatal car accidents in 2011 and even a pedestrian.  While statistics show that fatal accidents are not all too common in White Plains, they do happen and can tear lives apart.  If you have been injured in any way from any kind of accident and wish to seek compensation, a personal injury lawyer can help you.

“Personal injury” is a legal term that is used to describe many situations in which an individual may suffer from physical or emotional harm due to the actions of another individual or corporation.  Lever Gottfried Ecker PLLC works diligently to represent individuals and their families who have suffered and experienced unfortunate situations where the careless acts of another have caused them significant physical or emotional harm.  As personal injury lawyers, it is our job to determine who may be responsible for your injuries and prove that they are liable under applicable laws.

Our Duty is to Represent You and Obtain Justice

The duty of a personal injury lawyer is to prove that the fault in a personal injury case was of the defendant (usually an individual or a corporation).  Our goal is to work with you on your case and seek justice on your behalf.  We will work to hold the party that caused your injuries responsible in court.  The law states that we are responsible for proving the following points in court in order to gain compensation:

  • Duty – The defendant (the person who allegedly caused the harm/accident) had a duty to act or not act in a certain manner
  • Breach of Duty – In most personal injury cases, the plaintiff must prove that the defendant breached their duty, meaning that they acted inappropriately
  • Damages – We must show that you incurred damages in the form of a serious injury
  • Causation – Lastly, the plaintiff must establish that the defendant’s actions were the cause of their injuries

These four elements are necessary to successfully bring forward a personal injury lawsuit.

Workers Compensation

After suffering injuries in a workplace accident, many people return to work as if nothing happened to them. Many workers feel like they can’t mention or complain about their injuries because they fear taking time away from work will aggravate their bosses. Many companies, however, are reluctant to pay these benefits in many cases. That is where the experienced lawyers at Lever Gottfried Ecker come in. We can help you obtain the worker’s compensation benefits that you deserve.

A lot of the time, the wonderful doctors of New York will take care of you. There are instances, however, that mistakes are made, and people are injured due to negligence by a medical professional. If you or a loved one has experienced a medical mistake that has led to injuries or other complications, contact the personal injury lawyers at Lever Gottfried Ecker, so we can help you pursue compensation.

Compensation For Personal Injury Claims

Back Injury After Accident in New York

Often, the victims of personal injury cases are fighting for monetary compensation (damages) for their injuries and suffering. The jury will decide in civil court if the “at fault party” (the defendant) is responsible for paying these damages. In many instances, we can defer investigators and experts to help prove the case against the defendant and to assist in your making your case as strong as possible. Our team of experienced lawyers evaluates different ways to present your case, and then we decide which way will maximize the compensation you can receive from the defendant under the facts and the law. Many personal injury cases include damages such as:

Compensatory Damages in a Personal Injury Case

A majority of the damages that are included in a personal injury case are listed as “compensatory.” This means that they are intended to compensate for what the plaintiff lost due to the accident or injury. These damages are meant to make the plaintiff “whole” again in the monetary sense.

Putting a dollar amount on the damages from the accident can be complicated. Some damages are easy to monetize, such as reimbursement for medical bills or property damages, but other damages can be extremely difficult to quantify. Assigning a monetary value to pain and suffering and loss of quality of life due to injuries related to the accident can be very difficult. We’ve broken down the different types of compensatory damages for you below:

Medical Treatment
The damages included in a personal injury case award almost always cover the cost of the plaintiff’s medical care associated with the accident. This will serve as both a reimbursement for the treatment you already have received due to the accident and to cover the cost of future medical care.

Lost Income
Part of the compensation you receive may be to compensate for the incident’s impact on your wages and earnings. This could cover the income you lost due to the accident but also income you will not be able to make in the future. In specific legal terms, the victim’s “loss of earning capacity” dictates the damage based award.

Property Loss
If there were items damaged in the accident, automobiles, personal objects, etc., you would most likely be entitled to reimbursement for the required repairs, or if the item were damaged beyond repair, you would probably receive compensation at market value to replace the item.

Pain and Suffering
We are now moving into the damages that are more difficult to quantify. Compensation for pain and suffering is meant to try to amend for any pain you suffered from during and after the accident.

Emotional Distress
Damages listed for emotional distress are intended to compensate you for any psychological distress caused by the accident such as fear, anxiety, loss of sleep, and depression. In some states, emotional distress damages fall under the pain and suffering category.

Loss of Enjoyment
In cases where the injuries you sustained from the accident prevent you from participating in recreational activities, exercise, and hobbies you enjoyed before the accident, you may receive damages to compensate for this.

Loss of Consortium
These damages are meant to compensate for the impact the accident and the plaintiff’s injuries had on your relationship with your spouse. It can mean either a loss of companionship, the loss of a sexual relationship, or a combination of these factors. These damages can also be awarded because of the impact of the accident on the relationship between a parent and their child. These damages can be awarded directly to the family member who is suffering as opposed to the plaintiff.

Punitive Damages

In some cases, you may receive an award for punitive damage in addition to any compensation you may have received. These punitive damages are awarded in cases where the conduct of the defendant was found to be excessively careless and more egregious than usual. Although these damages are awarded to the plaintiff, instead of being awarded with the intention to make the plaintiff ‘whole’ again, they are awarded with the intention to punish the defendant and act as a deterrent. Many states have set a maximum limit for punitive damages since it is not unusual for these awards to exceed the ten million dollar mark.

Mental Trauma After Injury

Common Injuries That Lead To Personal Injury Cases

There are seemingly countless injuries caused by the negligence of another person that could lead to someone filing a personal injury claim. Below, we will take a look at some of the most common injuries people sustain in personal injury cases.

Traumatic Brain Injuries

Brain injuries are some of the most common injuries we see in personal injury cases. Brain injuries are a common result of car, truck, and motorcycle accidents, as well as slip and fall accidents in New York. A brain injury can have a significant effect on a person’s life in the long- and short-term. Symptoms of a brain injury can impair a person’s cognitive ability, physical abilities, emotions, and often cause a person to be left unconscious.

Neck Injuries

Neck injuries are also very common in the personal injury claims that we come across. Whiplash is a common issue that victims of motor vehicle accidents experience. Whiplash is caused by a sharp, sudden movement in the neck when a crash occurs. Victims of whiplash are often involved in rear-end accidents and are often subject to extensive pain and rehab to recover from their injuries.

Back and Spinal Cord Injuries

Accidents can cause a number of injuries to your back tissue, bones, and spinal cord. These injuries can be debilitating and very painful for their victims and often require extensive rehabilitation and treatment. Because the spinal structure is so essential to everyday function, those who acquire these types of injuries should seek legal counsel immediately if they are caused by the negligence of another party.

Burns

Burn injuries occur in all types of motor vehicle accidents, electrocution accidents, and can vary in severity. Burns can be relatively mild (first degree), or they can be very severe (third degree) depending on the circumstances of your accident. Nevertheless, if your burn was caused by the negligence of another party, you should contact us as soon as you can to discuss your legal options.

Broken or Fractured Bones

According to the American Academy of Orthopedic Surgeons (AAOS), there are around 6 million cases of broken or fractured bones each year in the United States. While some of these fractures and breaks merely need a cast and time to heal, other more serious compound fractures and shattered bones may require extensive surgeries, rehabilitation, and recovery time.

Damage to Internal Organs

Accidents can leave their victims with various types of damage to their internal organs including:

  • Punctured organs from broken bones
  • Ruptured spleen
  • Internal bleeding
  • Brain swelling
  • Blunt trauma to kidneys
